I have a problem. Hope you could give me advice.

I would like to employ a Philippine maid who are now employed by another employer currently. Due to some reasons (the elderly died, not the employer) and the employer is willing to release her with a good reason (she lost her main duties at this family to take care of the elderly who passed away already), and terminates her contract. It is good for me, as I want her to help me to take care my parents as early as possible.

But the problem is, when I submit the doc to the consulate, they ask me to submit ID522 as well. It seems that this form should only be issued by the immigration for 4 specified reasons. Consulate asked me to approach Immigration about this case, and Immigration may issue a letter to me for processing the contract in the consulate. And, the maid also needs to return to her original place and then submit the document again.

For me, I actually don't want she leaves HK because of my urgency. Do you think there is any exceptional case that this maid no need to go back her home place and stay in HK to start my contract? Please advise.

Do you think that I can get the letter from Immigration due to this case. Is it possible to let her stay in Macau or China for waiting the visa approval, will it be any trouble when she come back to Hong Kong. Will Immigration not approve her entry even she got the new visa on hand?

Urgently need your advice.

My understanding is that the maid must go back to her home country for her "home leave" after termination of her current contract wor. Asking her to stay in Macau or Mainland is not a legal practice (though I know some agents do make such arrangements for employers) which I would definitely advise against. Why don't you call Immigration Department to ask them verbally first?

If she go back Philipplines, I wonder she needs to pass through the agent to submit the application. I want to do it by myself in Hong Kong for everything.

Yeah, I understand your concern. Thus, I suggest you go and get the advice direct from Immigration Department. I think that's the quickest way.

Yes, I will go with her to the Immigration soon. Thanks.

But, I learned from some of the employer. Their maid will stay in China or Macau to wait for the visa. If it is true, I really want to try for this easy way.

Re. Macau & China arrangement. Again, I know some employers to do that but that's definitely illegal. Do think thrice before you go for it ah...

If the maid terminated by the employer for the following reasons, then she no need to go back to her original place :
1. financial problem
2. the elderly passed away (of course the main duty for the maid is to take care of the elderly) . so, do you have the ex-employer's letter?

Yes, I got her release letter with such reason, but not the employer died, only she lost her main duties for taking care of this elderly in this family. I hope the immigration officer will approve it.
