印傭主動遲職

我家印傭剛做滿了三個月, 她透露會主動跟我resign.

[問題一] 印傭的合約期為兩年, 可以提前解約嗎?

[問題二] 印傭提前解約, 她應負甚麼責任呢, 要有通知期嗎, 通知期要多久.

[問題三] 印傭主動遲職, 回程機票是僱主還是傭工付呢?

[問題四] What i need to pay here actually? and did maid need to pay me back the one month salary if she left immediately??

請多多指教.

印傭主動遲職

[問題四] What i need to pay her actually? => her salary this month + 2 (or 3) days anneal leave + air ticket + Hk$100 allowance.

PLEASE MAKE SURE HER GIVE YOU A RESIGN LETTER WRITTEN BY HERSELF. THIS IS VERY IMPORTANT.

IF YOU NOT SURE WHAT TO DO, YOU SHOULD CALL YOUR AGENT ASAP.

Why i Must need her resign letter? For what purpose ?
If no, what will i suffer?

And if she work for only 2 months here, is annual leave should be 7day(1yr) / 12 x 2 = 1.16 days salary??

and, 僱傭稅$2,400, not use enough半年, can I apply for the next maid??

and, 僱傭 ...

1.因為現在有很多工人雖然是自己resign,但如僱主沒有要求resign letter,她反轉說是僱主即時解僱她,而要求1 個月人工補償.所以由工人自己寫的resign letter is very important.
2.levy是可以帶給下個工人的,但你需於4個月內聘請工人,同時可計算的金額是按整月計算,即如你的工人工作2個月零1天,則只可計回3個月.

其實如你真的按照勞工法例計年假:
7days x 60days / 365 days=1.16 days
雖然是1.16days也要付2 days 的.

我個工人做左2個月就主動遲職, 佢話宜家一個月通知你, 我一個月後走, 我話唔洗你通知了, 可以宜家立即走, 佢死都唔肯, 一定要起我屋企住多一個月 wor, 我有 new born baby, 點會比個工人住多一個月呀, 咪走去同 agent 講數, 點知個 agent 死幫住個工人, 要我補多一個月比佢, 先至可以立即走, 真激氣.

一個月通知 $3480
回程機票 $2090
車錢 $100
Agent $2800
政府 $2400
人工 x 2 $6960
驗身 $700

個工人都未揍過 baby 就話唔做, 只係想來香港行下 wor, 激死我啦 !!

政府 $2400, 只要四個月內再請新工人, 就可以做轉工人名手續便可, 不用另外收費.

係人resign 都要俾resignation letter 架啦！佢要black and white confirm幾時走等僱主plan請人代替架嘛, 到時佢突然反口話唔走, 你又請咗人咪俾佢玩殘 ！

Now i hv't got her correct resign letter, what can i do?????

she has the right to give u 1 mth notice. of course it's not safe to keep her for 1 mth, n u insisted she need to leave immediately then i am afraid u can't claim her the 1 mth notice.

唔得, 如佢要即走, 一係佢補錢比你; 一係你即炒佢, 咁當然你要比代通知金.
唔好心軟比佢走, 否則拎住呢封信, 已足夠去LD開你file claim你一個月代通知金.

咁都得??我講個AGENT呀.

您點解唔即時同個工人去勞工處呀,同佢地d職員講,工人比 個月通知辭職,但您依家願意唔收佢一個月通知,叫佢即走嘛.個agent真係忽忽地架.
不過當然您要有佢辭職信啦.

Hi Yorn

try to give her a letter sample. and ask her to copy yours. as simple as you can, just state that
-her own reason want to resign
-with effect from which date
-don't forget to put down the date of the letter

if she want to leave immediately, can you call the police?? (because as I know if you want her to leave immediately and she does not want to leave, you could call the police)

some time agent will stand on the maid's side. don't just lay on the agent. you may also call a few agent and ask them to give suggestions.
