我個菲傭在1月15日新來我家工作, 但在2月2日向我請假要在2月3日回菲律賓, 因為她奶奶死了...於是我放佢假, 要佢在2月6日回來。
昨天晚上, 佢從菲律賓打電話給我說她不回來了...我怎麼辦??
我要上班, 有2個女, 3歲同一歲半, 現在好煩呀~~
問題1:我要出人工及機票比佢嗎?
問題2:如何解約?
問題3:想佢回來, 何以點做?

Yes, you need to pay her salary & one way airticket fr HK to Philip. However, she also needs to pay you $3580 for the one mth notice to you for her resign.

Ask her to give you a resign letter and send to imm.

真係服了你, 你仲諗住想佢番黎呀? 佢番你都唔好要啦!!!

你叫佢寫番去resign letter俾你啦, 否則, 呢件事會一路有機會有手尾跟架. 你同佢講明, 佢無俾一個月通知你, 就係你未出的人工內扣除, 扣埋機票錢, 餘數既算數啦, 望佢肯寫俾你啦!

佢唔肯既, 我諗你好似其他媽咪講, 寄掛號信去菲俾佢, 限定佢幾時要出現, 否則將佢礦工. 封信, 你都可以考慮cc埋俾immigration啦. 要快手呀, 唔好拖了!

First of all, are you able to contact her again? Phone number, and home address of her?

If you can, send a registered mail to her to ask her come back (to her home address)..Stating:

1. that she's absent from work without reason and this would cause her to be summarily dismissed.

2. stating as well that sHe had told you on phone on (date) that she wanted to resign verbally. But that you have not received her written resignation letter.

2 days later, send another , of same content, if there's no response, stating you haven't received her answer in the past two days.

Then another, if still no response.

Remember not to tell any word, "termination", in your letters.

One week later, after you have gathered all three letters, issue a termination letter, to her home address, telling as well that she owes you 1 month payment n lieu of notice. CC to the immigration department, stating all the above facts as the ground for terminating her....

Then you're done...

DOn't expect her to come back cuz I bet she won't!

First, You must contact the Agency and send the termination letter to the Immigration ( You must write down the reason is your maid told the lies and without any resignation reason or letter to inform you, you must directly inform the immigration you were cheated by the maid, Remember, you must request the immigration input your maid into their blacklist.)
Second, you must make the report to the Labour Department and tell them the facts.
Third, you must employ the Chinese People
( Chung Dip ) for tempoary to take care of your children.

我已經簽了終止書交比Agency喇, 不過Agency話佢未夠一個月都未到出量就自己走左, 可以唔出量比佢, 同埋係佢自己話走, 機票要係佢自己出...
我想問Agency叫我咁做是否正確呢?

Don't trust the agency. You have to pay a sigle way return home airticket to her no matter she resign or you fire her + her salary.
However she needs to pay you one mth notice in lieu ($3580) as she never give you resign notice before she back to home country.
Make sure you list out the above in details, sign an agreement with her, to avoid any trouble in the future.
Agency of course tell you no need as they want to do less job

我已SEND左封信比入境處, 列名佢走既原因, 但係有關錢及一個月通知等大家都做唔到, 因為連絡唔到佢本人...
唔知咁會否有手尾跟呢????

oh poor you. what would such thing happen? Is she new to HK or you just hired her after she finished her previous contact?

The more I read in this forum the more i hate helpers!!!
